The Firm

Schürmann & Partner was formed in 2008 on the strength of the team members' many years of experience in large German and international law and tax consulting firms. The firm's roots go back to 1998 in Frankfurt am Main. Schürmann & Partner strives to uphold the tradition of a comprehensive consulting philosophy, where clients will find a partner who supports them individually and personally.

Long-term impact is an important feature of our work. We can rely on as many as 18 years of professional experience amongst our partners. Our team's areas of activity include consultation and arranging legal and fiscal matters, as well as the enforcement of interests judicially. An open and goal-oriented consulting and support service is a deciding factor in our mutual success. We aspire to give you clear and understandable answers in a market that's becoming more complex by the day.

Together with our cooperation partners we'll also oversee your international transactions.

Services

Schürmann & Partner consults its clients on all matters of national and international economic law, company law, tax law and commercial law. Many of our clients enjoy an all-round service, while others seek advice in one of our areas of expertise for particular cases. Schürmann & Partner functions as an in-house legal department for many clients. We offer full support to these clients in matters of company and procedural law.

Clients often come to our law firm with special problems that require special solutions. These problems and their solutions often don't fit into any one category. They frequently touch on many different fields of law and sometimes constitute a completely new branch of law. The main focus of our service is primarily on the following fields:

· Business startup and restructuring, company taxation

· Real estate law, building law, commercial rental and lease contracts

· Labour law and co-determination

· International and national economic law

· Transactions and acquisitions

· Competition law, copyright, industrial property protection

· Inheritance law

· Litigation

· Criminal code for tax offences, white-collar crime defence

· Auditing

Business startup and restructuring, company taxation

Schürmann & Partner and their cooperation partners help clients to start up new businesses and give comprehensive tax advice on such endeavours. Our service in matters of company law includes the drafting of legal documents and statutes, as well as advice on partnerships, foundations and associations. We advise our clients on shareholder agreements, buying up equity and on matters relating to financing family businesses.

Real estate law, building law, commercial rental and lease contracts

Schürmann & Partner provides services in the following areas of real estate law: commercial rental and lease contracts, acquisition and sale of properties, property developer projects and building cooperatives, building of office complexes, portfolio acquisition and liquidation, mortgages, tenancy law, municipal building planning, and home sales.

Labour law and co-determination

Our services in the field of labour law cover individual and collective labour law. We advise both employers and employees on individual labour law while drawing up and signing employment contracts. We represent our clients in labour courts, including cases of wrongful dismissal. We advise our clients during collective bargaining and when dealing with government authorities and works councils.

International and national economic law

Our lawyers and accountants have wide-ranging international experience. We draw up national and international contracts for all areas of economic law. Our field of activity includes the negotiation of joint ventures and takeover agreements concerning technology transfer; sales agency agreements; order and distribution agreements; licences; project financing and credit agreements; advertising, publication and marketing agreements; employee and management contracting; confidential matters; and building contracts.

Together with our tax consultants in Frankfurt am Main, as well as the partner offices of ADVOSELECT EWIV in Europe and the United States, and a network of law firms within Europe that we work closely with, we represent companies internationally when advising them on their investments or projects.

Transactions and acquisitions

We advise our clients on a variety of fiscal and legal questions when it comes to the acquisition and sale of existing companies and businesses, e.g., joint ventures, takeover bids, spin outs and other procedures.

Our lawyers, accountants and tax consultants take fiscal and legal aspects into consideration when planning pending transactions; they help with the negotiation, the preparation, the implementation and the management of the required agreements and other documents. They provide legal advice on questions that arise during such transactions.

Competition law, copyright, industrial property protection

Our lawyers advise our clients on licence and franchise contracts. We research logos, trademarks and patents. Our lawyers are familiar with the problems relating to national and international copyright infringements. This includes industrial property protection, licensing, IP law for software and computer data, as well as copyright for artists, directors and musicians.

Inheritance law

We advise our clients on matters of inheritance and assist in the writing of wills. Our lawyers, accountants and tax consultants also act as executors.

The tax consultants take tax issues into consideration during the consultation – especially inheritance and gift tax, as well as property tax. Together with our clients we develop a strategy for business succession in family businesses, ensuring a smooth change from one generation to another.

Litigation

We represent our clients in court and before administrative authorities in Germany. Our partner offices also make this possible in almost every European country and in the United States (Seattle). We handle almost every type of litigation: general contract and trade disputes; disputes relating to company law; environmental and product liability cases; cases relating to building and real estate law; matters of competition law and industrial property protection; matters relating to banking laws and insurance; cases relating to insolvency law; labour law disputes; and copyright issues.

Criminal code for tax offences, white-collar crime defence

We advise and serve our clients prior to judicial inquiries relating to the criminal code for tax offences and represent them before the revenue authorities, the penalty and fine payment offices of the tax authorities, and the public prosecutor's office. We'll also advise and represent companies or their executives in matters of white-collar crime defence, especially in the field of insolvency counseling and recapitalisation.

Auditing

Our accountants advise SMEs, public companies and credit institutes in all economic matters. We gladly offer our clients assistance in matters of business valuation, due diligence, financing, treasury and financial accounting (especially according to IFRS). The firm's accountants also act as expert witnesses and provide partisan valuation reports. Furthermore, we also advise and serve clients in matters of restructuring and crisis management.
